Preventing Dooring: Ontario Car-Door Collisions and Insurance

Separate road rules from insurance fault, and learn practical ways to prevent dooring.

Opening a parked car’s door can injure a passing cyclist or pedestrian, or damage another vehicle. Both drivers and passengers should check before opening a door, even when the vehicle is stationary.

Road rules and insurance fault are different questions

Section 165 of Ontario’s Highway Traffic Act addresses opening and leaving doors open on a legally defined highway, requiring appropriate precautions. “Highway” is a legal term; the provision should not be described as automatically applying to every private parking lot. Highway Traffic Act. Careful observation is important wherever you park.

For a collision between automobiles, insurers apply the relevant Fault Determination Rules. Under section 19(c), an incident involving the driver or passenger of vehicle A opening or leaving its door open ordinarily assigns 100% fault to A’s driver and none to B’s driver. Other simultaneously applicable rules must also be considered. A passenger opening the door does not automatically remove the issue from the vehicle’s insurance fault assessment. Ontario’s Fault Determination Rules.

An injury to a cyclist or pedestrian needs its own legal and coverage assessment. Do not apply a two-automobile fault percentage as the complete legal answer. Police charges also do not, by themselves, settle insurance fault.

Which coverage may pay for vehicle damage?

When its conditions are met, your own DCPD coverage may respond to the not-at-fault portion of vehicle damage. Conditions include an Ontario accident involving another automobile that meets the insurance requirements, and no written election to give up DCPD recovery. Simply identifying an insured other driver is not the entire test.

Your at-fault vehicle damage may require Collision or another applicable coverage. An unidentified hit-and-run is not automatically a DCPD claim, while an identified uninsured vehicle may involve different provisions. Ask the adjuster to confirm coverage, evidence and deductibles. FSRA’s claims guidance.

Finding the other driver does not guarantee full reimbursement or an unchanged premium.

Before opening a door

If an incident occurs

Help anyone injured and address immediate danger first. Call 911 for serious injury or an emergency. When safe, exchange details, photograph vehicle positions and the door, record witnesses, and report under local police rules and policy requirements. Do not stand in dangerous traffic to take photographs.

Auto Claims Contacts: Finding the Right Help After a Collision

Know who to contact after a collision, when to notify your insurer and what information to prepare.

After a collision, deal with safety first, then contact your insurer. Claims reporting, roadside assistance, policy service and your broker’s office serve different purposes.

Emergency help comes first

Call 911 for serious injuries, fire or an immediate danger. An insurance hotline cannot replace emergency services. For a non-emergency collision requiring police reporting, follow the police instructions where the collision occurred. Do not assume every situation is suitable for driving directly to a collision reporting centre.

Start with your policy and official websites

Identify the insurer named on your policy. Use its claims instructions, official app or website. A-Z Insurance’s claims contact page can help you find the right starting point; confirm the details against your policy and the insurer’s current website.

CAA roadside assistance and CAA insurance claims are separate services. Use the official CAA Insurance claims page rather than assuming a roadside assistance number reports an insurance claim. Other insurers may also have separate claims, repair, billing and customer-service channels.

This article points to the contact directory instead of duplicating a phone list that could become outdated. If your insurer is not listed, consult your policy or its official website.

When should you notify the insurer?

In Ontario, report an auto accident involving injury or property damage to your insurer within seven days, or as soon as possible if you could not do so. Do not wait for a repair estimate or completed police report. Police reporting and insurance notification have separate requirements; there is no single 24-hour rule for completing every step with every insurer. FSRA’s post-accident guidance.

Some insurers take new claim reports around the clock. This does not mean every adjuster, broker’s office or claim decision is available 24/7.

Have these details ready

Record the claim number, contact person and next steps. Coverage, fault, repairs and deductibles depend on the actual policy and investigation.

If you need help identifying your insurer or the right department, contact A-Z Insurance at 905-707-2929 or info@azinsure.ca. Office advice is not emergency assistance. For a time-sensitive new claim, use your insurer’s official reporting channel directly.
